Introduction

Welcome to My AI Assistant. These Terms of Service explain your rights and responsibilities when using our services. By creating an account or using our services, you agree to these terms.

Services Provided

We provide AI-powered call answering and related features as described in your order form. Services include call handling, message transcription, and optional integrations. We may update or improve services over time with notice.

Account & Access

You must be at least 18 years old and keep your login details secure. You are responsible for all activity under your account. Sharing login credentials is prohibited. We may suspend accounts for security concerns or misuse.

Free Trial & Billing

You will receive a free 14-day trial. After the trial, payment for your selected plan will be automatically deducted from your nominated account on the same day every month unless you cancel before day 14 of the trial period.  If you commence your subscription and choose to cancel, all services will be removed from your account the day that your next payment is due.  If a payment is declined, your account will be suspended until payment is received. We may charge late fees or interest on overdue amounts.

Fees & Payment

Fees are charged as per your order form. Payment must be made on time. We may change fees with 30 days' notice. All fees are in AUD and include applicable taxes. You authorise us to process automatic monthly payments using your nominated method.

Privacy & Data Protection

We comply with privacy laws. Please review our Privacy Policy.  You are responsible for compliance with call recording and AI disclosure laws. We implement security measures to protect your data, but you acknowledge inherent risks in online services.

Acceptable Use

You agree not to misuse our services. Prohibited actions include: illegal activity, attempting to hack or disrupt systems, sending malware, or using services to harass or harm others. See our Acceptable Use Policy for full details.

Termination

You can cancel anytime. Upon cancellation, there is no transfer of your account or data to another provider. Outstanding fees must be paid before termination is effective. We may terminate for breach of these terms or unlawful activity.

Intellectual Property

All intellectual property in the services remains ours. You receive a non-transferable license to use the services during your subscription. You must not copy, modify, or reverse-engineer our services.

Liability & Warranties

Services are provided as-is. We do not guarantee uninterrupted or error-free service. Our liability is limited to the amount you paid in the last 6 months. We are not liable for indirect or consequential losses.

Dispute Resolution

If a dispute arises, both parties agree to attempt resolution through mediation before taking legal action. Mediation will occur in Perth, Western Australia.

Governing Law

These terms are governed by the laws of Western Australia. Any disputes will be handled in Western Australian courts.

Examples of prohibited use: sending spam, uploading harmful code, attempting to access other users' data, or using the service for unlawful surveillance.
